RABINOWITZ, Chief Justice. OPINION This appeal arises out of New York Life Insurance Company's refusal to make a $50,000 payment, under an accidental death policy, to Marian L. Rogers as the beneficiary. Resolution of the appeal turns upon the proper interpretation of the policy's aviation exclusion clause. Appellee Marian Rogers is the beneficiary of an insurance policy that was issued by New York Life Insurance Company on the life of Dr. William S. Stover. 1 New York Life paid the $50,000 face amount of the policy on proof of Dr. Stover's death; it refused, however, to pay the additional $50,000 demanded by Rogers under the policy's accidental death provision. Rogers subsequently brought suit seeking the $50,000 claimed under the policy.
